Remember, the D.C. Circuit Court of Appeals – the second most influential court in the country – has for some years carried an even split of Republican and Democrat appointees… The addition of three more liberal activist Obama-appointed judges would throw out ANY hope of balance in upcoming cases imperative to the future of our country, whether on Second Amendment rights, regulatory burdens, property, privacy rights – or ObamaCare!

Instead of helping Harry Reid court-pack and literally stack the bench with Obama liberals, the Republican Party needs to DENY ALL unanimous consent motions critical to moving forward Senate business – including the confirmation of these activist judges!

As Daniel Horowitz, writing for Red State points out, "Even after the nuclear option, 45 Senators have the ability to wreak havoc on the majority. Just one senator has the ability to slow down the Senate. It's all up to Mitch McConnell. He can end the year with a bang or a bust."

If the GOP refuses to ACT, Reid's HIGHLY STRATEGIC ploy will reach far beyond a merely partisan maneuver to prohibit filibusters against Obama's radical appellate court nominees.

"There is no clearer example of the Obama Administration's abusive view of federal power than its implementation of ObamaCare," Sen. Ted Cruz wrote in a legal memo on the White House's "lawless acts on ObamaCare."

"Congress should repeal ObamaCare in its entirety," Cruz wrote. "Until it is able to do so, however, courts should vindicate various pending lawsuits challenging ObamaCare under provisions such as the Constitution's Origination Clause, the Free Exercise Clause, the Religious Freedom Restoration Act, and the text of ObamaCare itself. And more court challenges should be filed to stop the Obama Administration's lawless implementation of ObamaCare."

Reid's nuclear option MUST be defeated and reversed before Reid gets the courts packed with liberal jurists determined to save ObamaCare and Obama himself – and willing to sacrifice the rule of law and the Constitution to do so!

The emasculated Vichy GOP under McConnell and Boehner must do more than "plan hearings" in the House Judiciary Committee about Reid "going nuclear"! The Senate is now subject to "the law of the jungle," the "tyranny of the majority" that our Constitution's author James Madison and most of our Founders feared.

Madison wrote, "It is of great importance in a republic, not only to guard the society against the oppression of its rulers, but to guard one part of the society against the injustice of the other part."

It starts with the life-and-death battle over ObamaCare: "The heart of this action is directed at packing the D.C. Circuit because that is the court that will review the lawless behavior of the Obama administration implementing ObamaCare," Cruz said.

Cruz says Obama and the Harry Reid Democrats believe that these simple majority-approved judges will be "rubber stamps" to keep as law the Affordable Care Act that America DOES NOT WANT. And they care nothing of constitutional "collateral damage" – in fact, they welcome it.

Sen. John Barrasso (R-WY), chairman of the Senate Republican Policy Committee, is likewise warning that the next stop for battling ObamaCare is the D.C. Circuit Court.

"Lawsuits affecting the healthcare law will go through this court, and if the president is able to pack this court, it's his effort to try to defend a law the American people don't like and believe they can't afford," Barrasso said.

Keep in mind, this is also the court second only to the Supreme Court in hearing Second Amendment cases critical to our constitutional right to keep and bear arms.

This battle cannot be solely prosecuted in our already corrupted courts. We MUST fight furiously in the political arena, on every question, in every possible engagement…

Because, IN HIS OWN WORDS, Harry Reid has 'destroyed the Senate as we know it.' There is no question he has dragged our ship of state into very dangerous waters.

This past summer YOU helped successfully thwart Harry Reid's threats to go "nuclear" or change the Senate rules from two-thirds (three-fifths – the 60 vote cloture rule) to simple majority vote (51 votes) on judicial and presidential nominations.

To advance Obama's extremist policies, Reid seeks to render the Republican Party – presently but not permanently – the Senate minority party, VOICELESS AND POWERLESS ON CAPITOL HILL. For now, via an illicit 48-52 vote to change Senate Rule XXII, he shamefully has done just that.

Reid, Obama and the Democrats, acting as totalitarians always do, plan by brute force to decimate all remaining fairness in the Senate and at the bench in our judicial system by "packing the court" with Obama's hard left nominees to the D.C. Circuit Court, in particular – and thus ensuring ObamaCare's survival through its many pending legal challenges.

Reid and his fellow Democrats are claiming that even though they have established a new (debased) standard of 51 votes to confirm appellate judges and executive branch nominees, they can somehow maintain the super-majority 60 vote standard for the Supreme Court. This is absurd, nonsense – either the reasoning for super-majoritarian checks on simple majorities holds, or it does not.

These checks were considered vital enough for the Founders to include them in the Constitution itself: Article V of the Constitution requires 3/4 of the states must ratify an amendment to the Constitution. Two-thirds majorities are required in the Senate to override a presidential veto and to convict U.S. officials impeached by the House of Representatives.

For 225 years, previous Senates have wisely sustained Rule XXII to require a super-majority to cut off debate, to apply a check and balance to the highly polarized passions enflamed by party and faction. The wisdom of the Founders, and Senators over two centuries, respected the need for procedural safeguards to protect longer term interests from shorter term contentions. Such concern for the common good and exercise of self-discipline is utterly absent today.

We now need STATESMAN; Republicans need to LEAD, to FIGHT NOW, and make it CRYSTAL CLEAR that if Reid and Obama persist in this change of the rules to pack the D.C. Circuit, Democrats concede they are also setting that standard for the next Republican Senate majority to appoint future Supreme Court nominees categorically, purposefully opposed to Roe v. Wade!

If there is to be no commitment to the Constitution, no respect for minority rights, and no effort toward consensus – then there will be no double standard and no future commitment to comity, no respect for precedent now abandoned – and mutually exercised raw majoritarian rule.

Because Obama is determined to govern as an unhindered despot – and Harry Reid needs a concerted effort to ADVANCE bad-for-America judges onto the D.C. Circuit Court of Appeals, to DISTRACT from the fiasco of ObamaCare and to suppress opposition to Barack Obama's agenda for the "fundamental transformation" of America.

Foundering Barack Obama hopes that such a "change" on Capitol Hill is exactly what the American sheeple will fall for… it's a dramatic ploy to further undermine our Constitution while he and Reid show his progressive base he is acting aggressively to break up the "gridlock" and GOP "obstructionism" that Obama of course likes to falsely blame for EVERYTHING that impedes his success, including the botched ObamaCare roll-out and the fatally flawed legislation itself!

"The gears of government have to work and the step that a majority of senators took today I think will help make those gears work just a little bit better," Barack Obama said in a statement.

"It's time to change the Senate before this institution becomes obsolete," Reid said on the Senate floor.

"The American people believe Congress is broken. The American people believe the Senate is broken. And I agree."

These liars and hypocrites said something very different when THEIR DEMOCRATS were the minority party. They are a disgrace to deliberative government, and we CANNOT let them get away with it – not with killing the filibuster, not with packing the D.C. Circuit Court, not with ObamaCare, not with gun control, not with amnesty.

Three Democrats – Sens. Carl Levin (Mich.), Mark Pryor (Ark.) and Joe Manchin (W.Va.) – honorably and patriotically stood against Reid's "nuclear" rules change… these and other possibly moderate Democrats are the same ones we need to help fight back against this administration's tyranny on numerous fronts. We MUST get more bipartisan defections from Obama's coup d'etat against the Constitution in which the White House via Harry Reid usurps the Legislative Branch – and Obama more and more becomes "sovereign" instead of We the American People.

Reid says there is just nothing else to be done due to Republican filibustering on radical Obama appointees… that McConnell and the Republicans broke their January promise not to filibuster Obama nominees except in "extraordinary circumstances".

Reid's action precipitates a Constitutional crisis, distorting republican representative government beyond recognition. THESE OBAMA NOMINEES TO THE D.C. CIRCUIT COURT OF APPEALS SO RUTHLESSLY AND STUPIDLY ADVANCED NOMINEES TO THE D.C. CIRCUIT COURT OF APPEALS WERE DISTURBINGLY PARTISAN PICKS TO A PREMIER FEDERAL BENCH – COMPLETE WITH ANTI-SECOND AMENDMENT JUDGE ROBERT WILKINS – and had NO prospects of winning bi-partisan consensus for confirmation. Hence, this action can only be understood as vulgar, ruthless abuse of power by the majority in oppression of the minority – exactly as our Founders and generations of statesmen before sought to contain!

Killing the filibuster will also allow the immediate nomination of Rep. Mel Watt (D-N.C.) to lead a housing regulatory agency, a crony appointment and a terrible idea, to go forward by simply majority as well!

In 2006, when the GOP majority threatened a Senate rule change by a 51-vote threshold, the Democrats SCREAMED that it was the wrong thing to do… but now power-tripping Harry Reid did just this in order to whip uncooperative Republicans in line!

This past summer, Senate Minority Leader Mitch McConnell (R-Ken.) called Reid's diabolical plan "one of the most consequential changes to the United States Senate in the history of our nation" one that "if they actually go through with it, they will live to regret." Yet what is McConnell's response?

McConnell said the "nuclear option" would "violate every protection of minority rights that have defined the United States Senate for as long as anyone can remember."

"Let me assure you: this Pandora's Box, once opened, will be utilized again and again by future majorities – and it will make the meaningful consensus-building that has served our nation so well a relic of the past," he warned.

Again – what is McConnell proposing to do about it? Pathetically, his main focus has remained on blasting US – Tea Party, Constitution-defending conservatives!

IT IS OBVIOUS…

REID HAS NOTHING BUT COMPLETE AND UTTER CONTEMPT FOR MCCONNELL. HE KNOWS JUST AS WELL AS WE DO THAT WHEN IT COMES DOWN TO IT, WILL FOGHORN LEGHORN MITCH MCCONNELL PUT ON HIS GLOVES AND FIGHT?

NO!

WE MUST STAND AND FIGHT WITH OUR PETITIONS AND OUR BALLOTS!

It is up to US to make sure that this "nuclear" coup does NOT go unanswered until next November. It is up to US to ensure it not only COSTS them their coveted simple majority come 2014 when 21 Democrats are up for re-election, but that it costs them as much debate, as much contention, as much arduous work defending their overweening ambition and abuse of power as we can command. We need to make sure it costs them the trust of the American People, and their entire "progress" of the past five years…

"If Sen. Reid changes the character of the Senate, then the Senate ceases to function. We'll take our case to the people, we'll argue for a new majority and then Republicans will be in a position to do whatever Republicans with 51 votes want to do," said Sen. Lamar Alexander (R-Tex).

ObamaCare could be repealed, the Keystone Pipeline completed and even the RIGHT TO LIFE protected with a "nuclear" Republican majority!

But we would do so at the terrible cost of sacrificing the rights of the minority…replacing our representative, republican form of government with a debased and dangerous form of direct democracy, invariably tyrannical and oppressive of minorities. Remember, when asked what government the federal constitution of 1787 had established, Benjamin Franklin responded: "A republic, if you can keep it."

Before we surrender it, we must fight to keep it.

Not that we 'care' what they have to say, but just to show the hypocrisy…

Sen. Rand Paul had already warned that once Reid goes nuclear, Republicans could demand the Senate consider a rule "stripping the majority leader of the power to prevent amendments to bills" or "require a two-third majority to raise taxes."

He continued: "even on a smaller scale, the fallout from a nuclear blast is severe – and it is nearly impossible to tell which way the winds will blow and who will be affected by the fallout."

THIS IS WHAT WE MUST DO!

Remember, this same Harry Reid Senate PASSED ObamaCare, the S. 744 Amnesty nightmare bill AND the gun control threats from this past spring ALL WITH THE SUPER-MAJORITY RULES IN PLACE.

This is the same Harry Reid who has many times over completely blocked Republicans from offering legislation AT ALL – not even amendments.

Townhall columnist Guy Benson noted during the last Congress that Reid has "employed this maneuver, known as 'filling the amendment tree,' more than his six immediate predecessors combined" in his efforts to "prevent the GOP from advancing amendments that would paint Democrats into difficult political corners."

We cannot allow Obama's Senate henchman Reid to simple-majority vote himself MORE POWER while the ill-led GOP just passively sits and hopes for Republican victory in 2014!
